1. About These Terms

These Terms and Conditions govern the sale and supply of natural stone, engineered stone, flooring, and stone craft products by KJM Stones LLC (“KJM Stones,” “we,” “us,” or “our”), 5229 FM 2001, Buda, Texas 78610. By requesting a quote, placing an order, or taking delivery of material from us, you agree to these terms. Where a signed quote, purchase order, or written agreement between us says something different, that document controls.

2. Who We Sell To

KJM Stones is a stone importer and wholesale distributor. We supply material to fabricators, countertop shops, builders, designers, and their clients. We supply material only — we do not fabricate. Cutting, templating, edge work, polishing, seaming, and countertop installation are performed by your fabricator, not by us, and we are not responsible for that work.

3. Quotes and Pricing

Quotes are valid for the period stated on the quote. Unless the quote says otherwise, prices are quoted per slab or per square foot for material only and do not include fabrication, installation, sealing, freight, or applicable taxes. Prices are subject to change without notice on unquoted material, and are affected by import costs, freight, and tariffs outside our control.

4. Placing an Order and Holding Material

An order is confirmed when we accept it in writing. Because slabs are individual pieces, we can hold specific slabs for you with a deposit while you make a decision; the hold period is agreed at the time and the deposit is applied to your order. Slabs that are not confirmed within the agreed hold period are released back to inventory.

5. Natural Variation Is Not a Defect

Natural stone is a product of the earth. Variation in color, veining, pattern, background tone, mineral content, pitting, fissures, and finish is inherent to the material and is not a defect. Samples, photographs on our website, and digital slab images are representative only — they cannot reproduce the exact appearance of the slab you receive, and screens vary. Blocks and lots differ from one another, and a reorder of the same stone name will not match a previous order.

We strongly encourage you or your fabricator to view and approve the actual slabs at our yard before they are cut. Once you approve a slab, its appearance is accepted.

6. Payment

Payment terms are as stated on your quote or invoice. Unless we have agreed credit terms with you in writing, payment is due in full before material is released or delivered. We do not accept payment through this website; invoices are issued and paid through our invoicing system. Past due balances may accrue interest at the maximum rate permitted by Texas law, and we may withhold release of material and future orders while a balance is outstanding.

7. Delivery and Pickup

Delivery is available along the I-35 corridor and is quoted per load rather than at a fixed rate. Delivery dates are estimates and are not guaranteed. Unless agreed otherwise, delivery is curbside or to an accessible point at the site; you are responsible for providing safe, legal, and unobstructed access, and for the equipment and personnel needed to unload and move material once it is delivered.

For pickups, you are responsible for bringing an A-frame or rack suitable for transporting slabs, and for properly securing the load. We are not responsible for damage that occurs during transport in a vehicle we do not control, or for damage caused by inadequate racking or strapping.

8. Title and Risk of Loss

Risk of loss passes to you when the material is loaded onto your vehicle or carrier at our yard, or when it is delivered and accepted at the site you specify. From that point the material is at your risk, as set out in section 9. Title passes when we have received payment in full.

9. Inspection and Claims

Inspect your material before it leaves our yard. For pickups, check each piece as it is loaded onto your vehicle. For deliveries, check the material at the point of delivery, before our driver leaves. Point out any breakage, chip, crack, or shortage at that moment, while the material is still in front of both of us — photographs taken at handover help considerably.

Once material has left our yard on your vehicle or carrier, or has been delivered and accepted at your site, we are not responsible for it. That includes breakage, chipping, scratching, cracking, staining, and loss. Stone is fragile, and handling, transport, storage, and fabrication after it leaves our control are your responsibility.

We cannot accept a claim on material that has been cut, fabricated, installed, or altered in any way. Cutting a slab is acceptance of it.

If you believe we supplied the wrong stone or the wrong quantity, that is a different matter from damage — tell us in writing as soon as you notice and we will look into it.

10. Returns and Cancellations

Once material leaves our yard, it cannot be returned. All sales of slabs and flooring are final at the point of release or delivery. Slabs are individual pieces that are easily chipped, scratched, or broken in handling and transport, and we have no way to verify how material has been handled once it is out of our control.

An order may be canceled before the material is released, subject to any deposit terms agreed at the time of the hold. Special orders, custom sizes, and material brought in specifically for you at your request cannot be canceled once it has been ordered from the supplier.

11. Flooring Installation and Other Services

Where we provide flooring installation or any other service, that work is governed by the separate written estimate, scope, or contract for that job. These terms cover the supply of material and do not by themselves define the scope, schedule, or warranty of any installation work.

12. Care, Sealing, and Suitability

Natural stone requires appropriate care. Sealing needs, stain and etch resistance, heat tolerance, and suitability for a particular application vary by stone type. It is your and your fabricator’s responsibility to confirm that the material you select is suitable for its intended use. We are glad to share what we know about a stone, but selection is ultimately your decision.

13. Warranty and Limitation of Liability

We warrant that material we supply matches the slab, lot, or product you approved, subject to the natural variation described above. Except as expressly stated here, we make no other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

For any claim we do accept under these terms, our liability is limited to replacing the affected material, or refunding the amount you paid us for it, at our option. We are not liable for fabrication or installation labor, template costs, jobsite delays, lost profits, or any indirect, incidental, or consequential damages.

14. Intellectual Property

The content on kjmstones.com — including photographs, slab imagery, product names, text, and our logo — belongs to KJM Stones or is used with permission. You may not reproduce it for commercial purposes without our written consent. Our trade partners are welcome to use our slab photography to present material to their own clients.

15. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including quarry or supplier delays, port congestion, customs or inspection holds, shipping delays, tariff or regulatory changes, severe weather, and labor disruptions.

16. Governing Law

These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute arising out of or relating to these terms or to material we supply will be brought exclusively in the state or federal courts located in Hays County, Texas, and you consent to the jurisdiction of those courts.

17. Changes to These Terms

We may update these Terms and Conditions from time to time. The version posted on this page at the time you place an order is the version that applies to that order. We will revise the “Last updated” date above whenever we make a change.
